From the Sonoma County Cannabis Program: The County is currently in the process of updating the Cannabis Ordinance. Based on guidance from the Board, staff is working on amendments to align the Cannabis Ordinance with latest state laws, respond to feedback from the community and build on the lessons learned through the first 10 months of permitting.
These updates will be in two Parts. Part 1 has a limited scope and is focused on bringing forward amendments related to alleviating neighborhood compatibility issues by requiring use permits on smaller rural properties and aligning with state law where appropriate.
Part 2 will include a more thorough review of neighborhood compatibility and other implementation efforts that require robust outreach and staff analysis.

2019 Ordinance Amendments – Part 2

Medical Cannabis Program Ordinances and Policies (A) Adopt the Negative Declaration and approve the Medical Cannabis Land Use Ordinance amending the zoning code to permit and regulate medical cannabis businesses. (B) Adopt a Resolution amending the Uniform Rules for Agricultural Preservation and Farmland Security Zones to list medical cannabis cultivation as a compatible use within Agricultural Preserves. The Santa Rosa City Council will consider a ballot submission to impose a maximum Cannabis tax rate based on $38 per square feet of cultivation space, adjusted annually based on the CPI index, or up to 10% on gross receipts. For all other cannabis businesses (including nurseries, transporters, distributors, testing labs, manufacturers, dispensaries and delivery providers) the maximum tax rate would be 10% of gross revenues. The Proposed Medical Cannabis Land Use Ordinance is last on the agenda. It will be heard at 1:30 or later. The meeting will be webcasted from the Board of Supervisors website. The County of Sonoma proposes to amend the Zoning Code to regulate cannabis uses consistent with the Medical Cannabis Regulation and Safety Act, including cultivation, nurseries, dispensaries, laboratories, manufacturing, distribution, and transportation. The proposed Medical Cannabis Land Use Ordinance would allow both personal and commercial cultivation of medical cannabis with certain limitations. The Medical Cannabis Land Use Ordinance will apply to agricultural, industrial, commercial, resource and residential zones within the unincorporated area of Sonoma County.
